membership terms & conditions
These Terms and Conditions form part of your Membership Agreement with Elite Fitness (“Elite Fitness”, “we”, “our”, “us”). By signing a Membership Agreement, you agree to comply with these Terms and Conditions, including our Club Code of Conduct.
1. Membership Agreement
By becoming a member of Elite Fitness, you agree to be bound by these Terms and Conditions. Your membership permits you to use our gym facilities at our sole club location, subject to your membership type and payment status.
As a member, you may use the Club in accordance with these Terms and Conditions and the Club Code of Conduct.
2. Health and acknowledgement of risk
By entering into this Agreement, you acknowledge and agree that:
You are medically and physically sound to undertake a normal course of exercise.
You are aware that exercise is physically demanding and participation in gym activities, fitness classes, steam room, sauna, and related facilities may pose a risk to your health.
You use the Club facilities at your sole risk and responsibility.
You will seek medical advice prior to commencing exercise if you have any health concerns.
You will immediately cease activity and notify staff if you feel unwell, dizzy, faint, or experience pain or discomfort.
To the extent permitted by law, Elite Fitness is not liable for injury, loss, or damage sustained while using the Club facilities.
3. Membership Types and Access
Elite Fitness offers the following membership categories:
Classic Membership
Access to gym floor and equipment
Access to steam room and sauna
Does not include group fitness classes
Signature Membership (Weekly or Lock-In)
Access to gym floor and equipment
Access to steam room and sauna
Access to all scheduled group fitness classes
Group fitness classes are strictly available to members holding a Signature membership and are not included with the Classic membership.
Steam room and sauna access is available to all active members unless otherwise advised for maintenance or safety reasons.
4. Membership Payments
Direct Debit Authority
By signing this Agreement, you authorize Elite Fitness and any Third-Party Payment Provider nominated by Elite Fitness from time to time to:
Direct debit your nominated bank account or credit card for any instalments or fees due under your Membership Agreement.
Debit fees in accordance with the Third-Party Payment Provider’s Direct Debit Request and Service Agreement provided to you.
Payments will be deducted fortnightly from your nominated bank account or approved payment method.
It is your responsibility to ensure sufficient funds are available at each payment date. Failed payments may incur administration or dishonor fees.
5. Lock-In Contracts
If you enter into a lock-in membership:
You agree to maintain payments for the full agreed minimum term.
If you wish to cancel before the end of the lock-in period, the full remaining balance of the contract must be paid prior to termination.
Early exit is not permitted without payment of the outstanding balance unless required by law.
6. Non-Lock-In Membership Cancellation Policy
For memberships that are not subject to a minimum term:
You may cancel your membership at any time by providing written notice to Elite Fitness staff.
A minimum of 14 days’ notice is required prior to your next scheduled direct debit.
Direct debits scheduled within the 14-day notice period may still be processed.
Membership access will continue until the end of the notice period.
Any outstanding fees must be paid before cancellation is finalised.
Cancellation requests must be submitted in writing (email or in person). Verbal requests will not be accepted.
7. Membership Freeze
If you wish to temporarily freeze your membership:
You must contact Elite Fitness staff in advance to request a freeze.
Freeze requests are subject to approval and may be subject to minimum and maximum freeze periods.
Payments will continue unless a freeze has been formally processed and confirmed.
Memberships cannot be frozen retrospectively.
8. Use of Facilities
Members must:
Comply with all Club rules and staff directions.
Treat equipment and facilities with care.
Use steam and sauna facilities responsibly and in accordance with posted guidelines.
Wear appropriate gym attire and footwear.
All members must bring a large towel to every gym visit. No towel – no entry.
Elite Fitness reserves the right to suspend or terminate membership for inappropriate behaviour, misconduct, or breach of these Terms.
9. Club Code of Conduct
To ensure a safe, respectful, and enjoyable environment for all members, you agree to:
Respect & Behaviour
Treat staff and fellow members with respect and courtesy.
Refrain from aggressive, intimidating, abusive, or inappropriate behaviour.
Follow all reasonable staff directions.
We have a strict non-violence policy. Poor or offensive behaviour toward a member of staff or other members will result in you being asked to leave the Gym immediately and your membership may be suspended or cancelled.
Equipment & Cleanliness
Exercise in the Gym is not permitted without a large towel. Please be mindful of other members and wipe down any equipment after use.
Return weights and equipment to their designated areas.
Use equipment for its intended purpose only and follow any instructions provided. If in doubt, please ask our friendly staff for help.
Report damaged or faulty equipment to staff immediately.
All members and non-members are responsible for any damage they cause to Gym equipment or our facilities.
Attire
Wear appropriate gym attire at all times.
Enclosed footwear must be worn in training areas.
Steam Room & Sauna
Members below the age of 16 are not allowed in the sauna or steam room.
Follow all posted health and safety guidelines.
Use facilities responsibly and considerately.
For your own health and hygiene, we strongly suggest all members shower before entering the sauna or steam room.
When inside the sauna or steam room, please sit on a towel, do not shave, do not use oils, creams or cosmetic products and do not attempt to dry clothing.
Do not use oils or substances unless permitted.
Do not wet the hot coals as our saunas are dry saunas!
Safety
Do not train under the influence of drugs or alcohol.
Do not bring illegal substances or prohibited items into the Club.
Children are not permitted in training areas unless authorized.
Parking
Parking is available for members and guests while using Gym facilities. Please note we are not liable for any loss, theft or damage which might occur in the parking area.
General Rules
No unauthorized personal training within the Club.
No filming or photography of other members without consent.
Bags must be stored in designated areas. Lockers and cubby holes are available for use during Gym hours (not overnight). Please use them to store your personal items and to keep the Gym floor clear of loose items.
Personal belongings are brought into the Club at your own risk.
No food may be consumed on the Gym floor or in the group fitness studio. Drinks are allowed if in a closed plastic bottle or container.
Carers may attend the Gym with a member in their care provided they do not use any of the facilities or services at the Gym.
Members below the age of 16 must be accompanied by a parent or guardian at all times.
Members are not permitted to touch any electronic equipment in the Gym, including TVs, stereos or fans, without permission from a member of staff.
Consumption of alcohol, illegal substances or performance-enhancing substances is strictly prohibited at the Gym.
Smoking is prohibited anywhere inside the Gym or around the entry or exit points to the Gym.
Elite Fitness reserves the right to suspend or terminate membership without refund for serious breaches of the Code of Conduct.
10. Risk and Liability
To the extent permitted by law:
Elite Fitness is not liable for any injury, loss, or damage sustained while using the Club facilities.
You acknowledge that participation in exercise and use of steam and sauna facilities carries inherent risks.
You agree that you are responsible for your own personal property while at the Club.
11. Access Control and Anti-Tailgating Policy
Membership access to Elite Fitness is strictly limited to the registered member.
Members must not:
Allow any non-member to enter the Club using their access pass, key tag, or membership credentials.
Permit “tailgating” (allowing another person to enter the Club without their own valid membership or pass).
Share access credentials with any other person.
Each person entering the Club must hold a valid membership or authorised guest pass and must check in individually.
If a member is found to have allowed unauthorised access, including tailgating or sharing access credentials, Elite Fitness reserves the right to:
Immediately suspend the member’s access; and/or
Terminate the membership without refund; and/or
Charge any applicable casual visit or guest fees.
Unauthorised access is considered a serious breach of the Membership Agreement and Club Code of Conduct.
12. One-Day Free Pass – Terms and Conditions
Elite Fitness may offer a complimentary One-Day Free Pass at its discretion. By redeeming a free pass, you agree to the following conditions:
Eligibility & Validity
The pass is valid for one (1) day only from the date of redemption.
The pass must be used on the nominated date and cannot be extended, transferred, or exchanged for cash.
Only one free pass per person is permitted unless otherwise approved by management.
Elite Fitness reserves the right to refuse or withdraw a free pass at its discretion.
Access Inclusions
The One-Day Free Pass includes:
Access to gym machines and equipment
Access to free weights areas
Access to steam room and sauna
The pass does not include:
Access to group fitness classes
Personal training services
Conduct & Safety
Free pass holders must:
Comply with all Elite Fitness Terms and Conditions and the Club Code of Conduct.
Acknowledge that they are medically fit to undertake exercise.
Accept that use of the facilities is at their sole risk.
Elite Fitness reserves the right to remove any free pass holder from the premises for inappropriate behaviour or breach of Club rules.
14. Changes to Terms
Elite Fitness may update these Terms and Conditions from time to time. The most current version will be available at the Club and/or on our website. Continued membership constitutes acceptance of any updated terms.
15. Contact Details
For all membership enquiries, including freeze requests or contract questions, please contact Elite Fitness staff directly at our Club location.
1. If we fail to enforce any of our rights at any time, for any period and for whatever reason, this will not take away those rights and it does not mean that we may not do so in future. If we fail to notice or act if you breach any of the terms of this Agreement, this does not mean that your behaviour is acceptable.
2. We are not responsible if members cannot use the Gym because of an event beyond our reasonable control (such as fire, flood, epidemic or pandemic) or a road or building closure or something similar. Such events do not provide grounds to seek a cancellation of your membership or a reduction on membership fees for any period of time.
3. In the course of exercising or engaging in any activities whatsoever while using the Gym, you are injured or killed, we will not be liable except to the extent caused by our gross negligence. In this clause, gross negligence is defined in Clause 4 of Legal stuff you should know.
4. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission.
5. You acknowledge that you are aware of the inherent risks of injury or ill health resulting from use of the services of the Gym and from participation in exercise generally. In consideration of participation in activities within the Gym, you agree to release, hold harmless and/or indemnify Elite and/or the Gym from and against all actions, which may be brought about by you or on your behalf in respect of any incident arising out of injury, loss, damage or death caused to you or your property in any way whatsoever.
6. You agree to participate in all activities at your own risk and responsibility, whether supervised or not by Elite staff or Gym instructors.
13. termination
1. We may terminate your membership immediately by email and/or post at the email or contact address we have on our records (see clause 7 under About Your Membership):
1.1. If you breach this Agreement;
1.2. If any part of your membership fees remain unpaid 28 days after falling due;
1.3. If you provide us with membership details which you know to be false and these false details may have affected our reasonable decision to grant you membership.
2. If we terminate your membership for any of these reasons, we may (without limiting any other right or remedy) recover any other reasonable costs and expenses we incur as a result of your breach and to collect the full amount of membership fees for the remainder of the billing period and any arrears. We may use a third party apart from Debit Success to assist in the collection of outstanding fees.
3. You may terminate your membership after minimum term by providing us with 14 days’ notice at least 3 days before the date of the next billing period and by completing a cancellation form at the Gym.
4. Upon cancellation of your membership, you will be required to return your tag to the gym. If we do not receive your tag before the last date of your final payment, a charge of $30 will be deducted along with your final payment.
5. If you terminate your membership within the minimum term stated on your membership form, you will be required to pay the balance of fees owing to the end of the minimum term, including any fees in arrears.
6. If you wish to terminate your membership within the minimum term due to a permanent disability or long-term injury that will not be recuperated before the end of your term, a medical certificate must be provided stating the nature and duration of the disability or long-term medical issue.
