We only collect personal information that is reasonably necessary for our business operations.

2. How We Collect Personal Information

  • When you redeem a free pass

Where reasonable and practicable, we collect personal information directly from you.

3. Anonymity and Pseudonymity

Where lawful and practicable, you may choose to interact with us anonymously or using a pseudonym (for example, when making a general enquiry).

However, it is not practical for you to remain anonymous when entering into a Membership Agreement, redeeming a free pass, or using our facilities, as we require identification and contact information to provide services and maintain safety.

  • Managing class bookings (Signature members only)

5. Direct Debit & THIRD-PARTY Payment Providers

By entering into a Membership Agreement, you authorise Elite Fitness and any Third Party Payment Provider nominated by us from time to time to process payments in accordance with your Direct Debit Request and Service Agreement.

Your payment details may be securely stored and processed by our nominated third-party payment provider for the purpose of collecting membership fees and related charges.

We take reasonable steps to ensure that third-party providers handle your personal information securely and in accordance with privacy laws.

6. Disclosure of Personal Information

We may disclose your personal information to:

  • Third Party Payment Providers

  • IT service providers and software systems used to manage memberships

  • Professional advisers (legal, accounting, or insurance)

  • Regulatory authorities where required by law

We do not sell your personal information to third parties.

We will not disclose your personal information to overseas recipients unless:

  • We reasonably believe the overseas recipient is subject to laws substantially similar to the Australian Privacy Principles; or

We will still send you essential service-related communications regarding your membership.

We take reasonable steps to protect personal information in accordance with APP 11, including:

  • Secure electronic storage systems

  • Password protection and access controls

  • Secure disposal or de-identification of personal information when no longer required

If we become aware of an eligible data breach (as defined under the Privacy Act 1988 (Cth)), we will comply with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC), where required.

9. CCTV Surveillance

Elite Fitness may use CCTV surveillance within the Club for safety, security, and operational purposes.

CCTV footage may be used:

  • To ensure member and staff safety

  • To investigate incidents

  • To protect Club property

CCTV recordings are stored securely and accessed only where necessary.

10. Access and Correction

You have the right to request access to the personal information we hold about you and to request correction of inaccurate, out-of-date, incomplete, irrelevant, or misleading information, in accordance with APP 12 and APP 13.

We will respond to access or correction requests within a reasonable period. In some circumstances permitted by law, we may refuse access and will provide written reasons for the refusal.

We may require you to verify your identity before processing your request.

General Filming Within the Club

CCTV surveillance operates within the Club for safety and security purposes. CCTV footage is not used for marketing and is handled in accordance with our Privacy Policy.

Promotional Photography & Video

We will not use identifiable images or video footage of members for promotional or marketing purposes without prior consent.

If you consent to being photographed or filmed for promotional purposes:

  • Your image, likeness, or voice may be used on Elite Fitness’ website, social media platforms, digital displays, or promotional materials.

  • You acknowledge that such materials may be publicly accessible.

  • You understand that you will not receive financial compensation for the use of your image.

You may withdraw your consent at any time by notifying us in writing. Withdrawal of consent will apply to future use only and will not require the removal of materials already published where it is not reasonably practicable to do so.

Member Responsibility Regarding Filming

Members must not photograph or film other members or staff without their express consent.

Unauthorised filming or photography within the Club may result in suspension or termination of membership.

14. privacy Complaints

If you believe we have breached the Privacy Act 1988 (Cth) or the Australian Privacy Principles, you may lodge a complaint with us in writing using the contact details below.

We will:

  • Acknowledge your complaint within a reasonable timeframe;

  • Investigate the complaint; and

  • Provide a written response outlining our decision.
